These Terms and Conditions govern your use of the KlōTHiNG Limited website and marketplace (klothing.co.nz). By accessing, browsing, or placing an order on our site, you agree to be bound by these terms. Please read them carefully before making a purchase.

1. About Us

KlōTHiNG Limited is Oceania's curated head-to-toe marketplace. From fine Merino wool and summer performance collections to accessories spanning everyday essentials, luxury pieces, and spiritual treasures — all under one roof. Our mission is captured in our tagline: Ko te kākahu, ko te tuakiri — "The clothing is the identity."

2. Access and Use of the Site

2.1   You must only use klothing.co.nz ("the Site") in accordance with these Terms and all applicable New Zealand laws, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, and the Privacy Act 2020.

2.2   You must not:

  • interfere with or disrupt the Site, or the servers and networks that host it;
  • use data mining, scraping robots, or similar data extraction tools on the Site; or
  • interfere with any security-related or other features of the Site.

2.3   To place orders, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement under New Zealand law. Persons under 18 may only place an order with the involvement of a parent or guardian.

2.4   You must provide accurate and current information when registering an account. You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

2.5   We reserve the right to suspend or terminate accounts used in breach of these Terms, or in a manner we determine, acting reasonably, to be fraudulent, abusive, or unlawful.

3. The KlōTHiNG Marketplace

KlōTHiNG Limited operates a curated multi-brand Direct-to-Consumer (D2C) marketplace. We partner exclusively with brands that meet our technical integrity and ethical standards. Every brand represented on klothing.co.nz has been reviewed and approved by our team.

3.1   Our collection spans:

  • Fine Merino and performance technical apparel — menswear, womenswear, and kidswear
  • Summer lifestyle and activewear collections
  • Head-to-toe accessories: beanies, gloves, scarves, socks, and neckwarmers
  • Luxury and spiritual accessories — all curated to meet our quality standard
  • Footwear — including our exclusive Oceania partnership with Ludic Life (India)

3.2   All pricing on the Site is displayed in New Zealand Dollars (NZD), inclusive of Goods and Services Tax (GST) at the current rate of 15%, in accordance with the Goods and Services Tax Act 1985 (NZ).

3.3   Product imagery, descriptions, and pricing are subject to change without notice. We take care to accurately represent all products; however, minor variations in colour may occur due to screen calibration differences. Where product images are generated or enhanced using AI tools, this will be noted on the relevant product page.

4. Orders and Contract Formation

4.1   By placing an order on klothing.co.nz, you are making an offer to purchase the selected products at the price displayed, inclusive of 15% GST. All prices are in New Zealand Dollars (NZD).

4.2   An order confirmation email acknowledges receipt of your order but does not constitute acceptance. A binding contract is formed only when we send you a shipment confirmation email.

4.3   We reserve the right to cancel or decline any order at our discretion, including where:

  • a product is out of stock;
  • there has been a pricing or description error on the Site;
  • we reasonably suspect fraudulent or abusive activity; or
  • we are unable to verify payment.

4.4   If your order is cancelled before shipment, a full refund will be issued to your original payment method within 5–10 business days.

4.5   Payment is required in full at the time of placing your order. We accept all major credit and debit cards and Buy Now Pay Later options where available. All payment processing is conducted through secure, PCI-DSS compliant payment providers.

5. Shipping — Free on All Orders

KlōTHiNG Limited offers FREE shipping on all orders to New Zealand and Australia. There are no minimum spend requirements and no hidden delivery charges. The price you see is the price you pay — inclusive of 15% GST.

5.1   All orders placed on klothing.co.nz include complimentary shipping to New Zealand and Australia. Shipping costs are absorbed by KlōTHiNG Limited as part of our Direct-to-Consumer model.

5.2   Orders are fulfilled by our brand partners and shipped directly to your door. Estimated delivery timeframes are:

  • New Zealand: 7–14 business days from dispatch
  • Australia: 10–18 business days from dispatch
  • These are estimates only. Actual delivery times may vary due to customs processing, courier delays, or peak periods.

5.3   Once your order has been dispatched, you will receive a shipping confirmation email with tracking details where available.

5.4   KlōTHiNG Limited is not liable for delays caused by customs authorities, courier services, or events outside our reasonable control. Risk of loss passes to you upon delivery to the address specified in your order.

5.5   You are responsible for ensuring your delivery address is accurate at the time of placing your order. We cannot redirect orders once dispatched. If a package is returned to us as undeliverable, we will contact you to arrange redelivery. Additional shipping costs for redelivery may apply.

6. GST and Taxes

6.1   KlōTHiNG Limited is a New Zealand-based business. All prices displayed on klothing.co.nz are inclusive of New Zealand Goods and Services Tax (GST) at the rate of 15%, in accordance with the Goods and Services Tax Act 1985 (NZ).

6.2   GST is the only tax applied at checkout. We do not impose any additional hidden charges, duties, or levies on orders to New Zealand addresses.

6.3   For orders shipped to Australia, Australian customers may be subject to Australian GST (10%) applied at checkout in accordance with Australian tax law. The applicable tax will be displayed clearly before payment is confirmed.

6.4   KlōTHiNG Limited complies with its obligations as a GST-registered entity under New Zealand law and issues GST-inclusive pricing on all transactions.

6.5   If you require a GST receipt or tax invoice for your purchase, please contact us at contact@klothing.co.nz with your order number.

7. Returns and Exchanges

7.1   Return Eligibility

We want you to be completely satisfied with your purchase. If for any reason you are not, you may request a return subject to the following conditions:

  • Returns must be reported to us within 7 days of the confirmed delivery date of your order.
  • The item must be unused, unworn, and in its original condition.
  • All original tags must be attached and intact.
  • The item must be in its original packaging, including any branded dust bags, protective covers, certificates of authenticity, and care instruction cards.
  • The return must have the approval of the brand partner whose product you are returning.

7.2   How to Initiate a Return

To initiate a return, please follow these steps:

  1. Email us at contact@klothing.co.nz within 7 days of your confirmed delivery date.
  2. Include your order number, your reason for return, and clear photographs of the item from all angles, including labels and any fault if applicable.
  3. Our team will review your request and, where applicable, seek approval from the relevant brand partner.
  4. Once the return is approved, you will receive a confirmation email with our Auckland return address and packaging instructions.
  5. Ship the item to our Auckland address. The cost of return shipping to our Auckland location is borne by the customer.
  6. Once we receive and inspect the returned item, a replacement will be dispatched (where stock is available) or a refund will be issued to your original payment method.
Return shipping costs to our Auckland address are the customer's responsibility. KlōTHiNG Limited will cover the cost of dispatching your approved replacement or exchange.

7.3   Brand Partner Approval

Because KlōTHiNG Limited operates as a marketplace platform, all returns require approval from the relevant brand partner before they can be accepted. Unapproved returns will not be processed and may be returned to the sender at their own cost.

We aim to respond to all return requests within 2–3 business days. Brand partner approval timelines are subject to the brand's own review process.

7.4   Non-Returnable Items

The following items are not eligible for return or exchange unless they are confirmed as faulty:

  • Items that have been worn, washed, or altered in any way
  • Items returned without original tags or packaging
  • Items reported beyond the 7-day window from confirmed delivery
  • Items specifically marked as "final sale" or "non-returnable" on the product page
  • Hygiene-sensitive items, including socks, singlets, and underwear, unless confirmed as faulty

7.5   Faulty or Defective Products

If you receive a product that is faulty or not as described, please contact us immediately at contact@klothing.co.nz. Your statutory rights under the Consumer Guarantees Act 1993 (NZ) apply in full. Where a product is confirmed to have a fault or defect, we will offer a replacement, repair, or full refund at no cost to you, including return shipping.

Normal wear and tear, misuse, or failure to follow care instructions does not constitute a defect.

8. Pricing

8.1   All prices on klothing.co.nz are displayed in New Zealand Dollars (NZD), inclusive of 15% GST. Prices are subject to change without prior notice.

8.2   We do not offer price matching with other retailers or websites. The price displayed at the time of your purchase is the price that applies to your order.

8.3   We do not offer price protection. If a product you have purchased is subsequently discounted or placed on sale, we are not obligated to refund the difference.

8.4   Promotional codes and discount offers are subject to their own specific terms and conditions. Only one promotional code may be applied per order. Promotional codes cannot be exchanged for cash and carry no residual value.

9. Intellectual Property

9.1   All content on klothing.co.nz — including text, imagery, logos, branding, product descriptions, and our tagline Ko te kākahu, ko te tuakiri — is the intellectual property of KlōTHiNG Limited or its brand partners and is protected under New Zealand and international copyright law.

9.2   You must not reproduce, copy, distribute, adapt, transmit, or publish any content from this Site without our prior written consent.

9.3   The KlōTHiNG name, logo, and associated branding are the property of KlōTHiNG Limited. Unauthorised use is strictly prohibited.

9.4   Product images and brand assets belonging to our brand partners remain the intellectual property of those respective brands. Their use is governed by licence agreements between KlōTHiNG Limited and the relevant brand.

10. Privacy and Data

10.1   KlōTHiNG Limited is committed to protecting your privacy in accordance with the Privacy Act 2020 (NZ). We collect only the personal information necessary to process your orders, communicate with you, and improve our services.

10.2   We will not sell, rent, or share your personal information with third parties for marketing purposes without your explicit consent.

10.3   Your information may be shared with brand partners and logistics providers solely to the extent necessary to fulfil your order.

10.4   You have the right to access, correct, or request deletion of your personal information at any time. Please contact us at contact@klothing.co.nz to exercise these rights.

10.5   We use industry-standard security measures to protect your data. However, no internet transmission is 100% secure. Please exercise care when sharing personal information online.

10.6   By using the Site, you consent to the collection and use of your information as described in these Terms and in our Privacy Policy, available on the Site.

11. User-Generated Content

11.1   Where you share content — such as reviews, photographs, or social media posts — referencing KlōTHiNG Limited or products purchased through us, you grant us a non-exclusive, royalty-free licence to use, reproduce, and feature that content across our marketing channels.

11.2   You confirm that any content you share is your own original work, does not infringe any third-party rights, and complies with all applicable laws.

11.3   You may withdraw your permission for us to use your content at any time by contacting us at contact@klothing.co.nz. We will remove such content as soon as reasonably practicable.

11.4   KlōTHiNG Limited reserves the right to remove any user-generated content that it considers inappropriate, offensive, or in breach of these Terms.

12. Disclaimer and Limitation of Liability

12.1   KlōTHiNG Limited operates the Site and marketplace to the best of our ability. However, we do not warrant that the Site will be available at all times, free from error, or free from viruses or other harmful components.

12.2   Nothing in these Terms excludes or limits your statutory rights as a consumer under New Zealand law, including those under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

12.3   To the extent permitted by law, KlōTHiNG Limited's total liability to you for any claim arising in connection with your use of the Site or a purchase shall not exceed the price paid for the product giving rise to the claim.

12.4   We are not liable for indirect, consequential, incidental, or punitive losses — including loss of profit, loss of data, or loss of opportunity — to the extent permitted by law.

12.5   Products must be used strictly in accordance with the manufacturer's instructions. KlōTHiNG Limited accepts no liability for loss or injury arising from the misuse of products.

13. Compliance with New Zealand Law

KlōTHiNG Limited operates in full compliance with all applicable New Zealand legislation governing e-commerce marketplaces, including:

  • Consumer Guarantees Act 1993 — guaranteeing fitness for purpose and acceptable quality
  • Fair Trading Act 1986 — prohibiting misleading and deceptive conduct
  • Privacy Act 2020 — governing the collection, use, and storage of personal information
  • Goods and Services Tax Act 1985 — requiring GST collection and remittance
  • Contract and Commercial Law Act 2017 — governing online contract formation
  • Electronic Transactions Act 2002 — governing electronic agreements and notices

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the New Zealand courts.

14. Dispute Resolution

14.1   If you have a complaint or concern about an order or your experience with KlōTHiNG Limited, please contact us in the first instance at contact@klothing.co.nz. We will endeavour to resolve your concern within 5 business days.

14.2   If a resolution cannot be reached directly, you may refer the dispute to the Disputes Tribunal (disputes.govt.nz) for claims up to NZD $30,000, or to the New Zealand courts for claims of a higher value.

14.3   KlōTHiNG Limited is committed to engaging in good faith with any dispute resolution process and aims to resolve all customer concerns fairly and promptly.

15. Changes to These Terms

15.1   KlōTHiNG Limited reserves the right to update or amend these Terms at any time. Updated Terms will be published on klothing.co.nz with the revised date clearly noted.

15.2   Your continued use of the Site following any update to these Terms constitutes your acceptance of the revised Terms.

15.3   Where changes are material, we will endeavour to notify registered customers by email in advance.

16. General Provisions

16.1   Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and KlōTHiNG Limited regarding your use of the Site. They supersede all prior communications, representations, or agreements relating to the subject matter herein.

16.2   Severability. If any provision of these Terms is found to be unlawful or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

16.3   No Waiver. Our failure to enforce any right or provision under these Terms on any occasion does not constitute a waiver of that right or provision on any future occasion.

16.4   Assignment. You may not assign, transfer, or sub-licence your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to any successor entity or related company without restriction.

16.5   Force Majeure. We shall not be liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, telecommunications failures, or infrastructure disruptions.

16.6   Notices. Any notices required under these Terms should be sent in writing to contact@klothing.co.nz. We will send notices to the email address associated with your account.

16.7   Governing Law. These Terms are governed by and construed in accordance with the laws of New Zealand. You and KlōTHiNG Limited submit to the exclusive jurisdiction of the courts of New Zealand for any dispute arising out of or relating to these Terms or your use of the Site.
